PTX AS, the team behind the PTX App, is committed to your privacy. We want your personal data to be private and secure. In this Privacy Policy, we explain:

  • What personal data we collect and how

PTX AS (hereinafter "we" or "us") is a Norwegian limited liability company. We promise to adhere to applicable Norwegian privacy law and meet the minimum requirements according to applicable laws and regulations within the EU/EEA, including the General Data Protection Regulation (GDPR), which comes into force May 25, 2018. We will ensure that your privacy rights and our processing of your personal data are held to the highest standard.

We collect and process data as described in this Privacy Policy. It is important that you read this Privacy Policy thoroughly. We want you to be aware of your rights so you can help us become better. If you do not accept this Privacy Policy, you cannot use PTX.

2. What personal data we collect and how

Users are required to register some personal data. PTX also uses and stores cookies that may contain personal data (see section 2.8). Users can also choose to register optional personal data. If you choose to register as a Trainer, you are required to register some additional personal data. Personal data will in part be generated through your use of PTX.

2.1 Minimum personal data needed to register as a User:

  • E-mail
  • Full name
  • Password
  • Profile picture

Please be aware that your first name and your profile picture will be visible on your profile. Your profile is public and can be viewed by anyone accessing the PTX App.

2.2 Optional User personal data

Users can choose to add the following additional information:

  • Place of residence
  • Age
  • Gender
  • Interests related to sporting activities
  • Fitness level
  • Memberships in sports clubs, gyms and organizations
  • Fitness goals (e.g. weight loss, learn windsurfing)
  • A text on the profile where you write something about yourself
  • Other pictures than your profile picture

Please be aware that if you do add such information, it will be visible on your profile together with your first name and your profile picture. Your profile is public and can be viewed by anyone accessing the PTX App.

2.3 Mandatory Trainer personal data

  • E-mail
  • Full name
  • Password
  • Profile picture
  • Other pictures
  • Year of birth
  • Gender
  • A text the Trainer writes about himself/herself
  • If the Trainer chooses to charge a fee for the sporting activity, he/she must also provide his/her date of birth, country of residence, address, and city and post code.

Please be aware that the Trainer's full name, profile picture, other pictures, gender and any text provided will be visible on the Trainer profile. The profile is public and can be viewed by anyone accessing the PTX App.

2.4 Optional Trainer personal data

  • Information regarding your competence as a Trainer: Certificates, education, courses
  • Area in which you reside
  • Merits regarding sports or fitness
  • Affiliations, e.g. if the Trainer works for a sports club or a fitness center

Please be aware that such optional personal data will be visible on the Trainer profile together with the Trainer's full name and profile picture. The profile is public and can be viewed by anyone accessing the PTX App.

2.5 Personal data generated while using PTX:

  • Location data (you will be asked to accept the tracking of location data)
  • Information about your mobile device:
  • IP-address
  • Mobile phone number
  • Manufacturer
  • Operating system
  • Service provider, etc.
  • PTX usage statistics
  • Information on the activities you book through PTX and the payments you make
  • Personal data you disclose in the chat function
  • Personal data you disclose when writing reviews of trainers and bookings

2.6 Sensitive personal data

Sensitive personal data is information relating to

  • racial or ethnic origin, or political opinions, philosophical or religious beliefs,
  • the fact that a person has been suspected of, charged with, indicted for or convicted of a criminal act,
  • health,
  • sex life,
  • trade-union membership.

We do not collect sensitive personal data. However, PTX has a chat function and other communication tools that enable Users and Trainers to communicate. If you disclose any sensitive personal data such as information about your health in the chat function or other PTX functions, we will process such information as described below in 2.7.

2.7 Chat and reviews

PTX has a chat function that enables communication between the Users and Trainers. We and subcontractors may access chat logs. We do not need or seek any sensitive personal data from our Users or Trainers for the delivery of PTX, and will seek to limit all Third Party access to such data. PTX also has other communication tools, like the ability for Users to write reviews of Trainers and activities. We encourage both Users and Trainers to not disclose any sensitive personal data through the chat or review function.

2.8 Cookies

Our website uses cookies. A cookie is a file which is stored on your web browser to enable our website to recognize your web browser each time you visit us, and to help the user access a site faster and more efficiently. Google Analytics:

We gather statistics on how our website is used with the specific purpose of improving it. We have enabled the function "anonymizeIP", so that your IP address is not stored on Google Analytics' servers. See Google Analytics Cookie Usage for more information.

Stripe:

We use Stripe to facilitate payments. Stripe uses cookies to remember who you are, to prevent and detect fraud, and to analyze and improve their services. For more information, see Stripe’s Cookie Policy.

Facebook Pixel:

We use Facebook Pixel on some of our pages to measure, optimize and build audiences for advertising campaigns. Facebook uses cookies for this purpose, and to track your usage and gather insights about the effectiveness of ads. For more information, see Facebook's Cookie Policy.

Functionality cookies and strictly necessary cookies:

In addition to third party cookies, we use cookies to remember who you are, to keep you logged in between sessions, and to remember your settings.

3. Purpose

We collect, store and use personal data for several purposes:

To provide you with the PTX App: We use personal data about you to be able to provide the App to you. The legal basis for this is the contract you entered into with us concerning the provision of the App.

To ensure the technical functionality of PTX: To do so we need information about how PTX functions on your device. The legal basis for such use of information is our contract with you to provide the App to you and our legitimate interests in providing an App that functions as well as possible.

To develop and improve the functionality of PTX: We want PTX to provide you with the best possible User experience. For this purpose, we use personal data that you have provided to us and that is generated while using the App to develop and improve the App. This is based on our legitimate interest in developing and improving the PTX App.

To be able to control and monitor PTX' User base: We process personal data you provide to us and that is generated while using the App to control and monitor the PTX App User base. This processing is based on our legitimate interest in being able to manage the App.

To provide you with relevant marketing and promotions from Third Parties through PTX, including ads, coupons or competition for real world prizes from a Third Party through PTX: We want to offer a free to play gaming experience. To do so we need to create income by offering promotions and marketing. We want the marketing you experience and the promotions you get to be as relevant as possible. For this purpose, we process personal data about you, and the legal basis for this processing is our legitimate interests in generating income from the App.

To ensure the safety of the Users: We process personal data that you provide to us and that is generated from the use of the App to ensure a safe and secure App experience. The legal basis for such processing is your legitimate interests in providing a safe and secure App.

To ensure secure payments: We process personal data that you provide to us and that is generated from the use of the App to ensure that any payments you make to us are secure. This is based on the contract you entered into with us concerning the provision of the App and our legitimate interests in ensuring secure payment for our Users and Trainers.

4. Disclosure of personal data to third parties, including subcontractors

If relevant for achieving the purposes described in this Privacy Policy, we may use subcontractors for processing personal data ("Sub-Processors") for the following purposes:

  • Data storage
  • Data analysis
  • Marketing

We ensure that all Sub-Processors enter into written agreements, including (if pertinent) agreements authorizing transfers outside the EEA. Sub-Processors are imposed the same obligations as us in relation to this Privacy Policy.

We will never sell, transfer or otherwise disclose personal data for other reasons than defined by this Privacy Policy unless required by law or with your consent. If we suspect criminal activity in connection with your use of PTX, we may choose to disclose information to the police upon demand.

5. Your rights

Consent: If our data processing is based on your consent, you can withdraw your consent regarding our use of your personal data at any time. If you want to withdraw your consent, we will delete your account within reasonable time, unless we have another legal basis for further processing of the data.

Access: You can request access, free of charge, to the personal data we have collected on you at any time. You can also request information about how we collect personal data at any time.

Erase & rectify: If certain conditions are met, you can request that we erase (delete) and rectify any collected personal data concerning you at any time.

Closing PTX account: If terminating or closing your PTX account, any information contained will be quarantined for 50 days. This period is applies to prevent fraudulently or mistakenly terminated or closed accounts by Third Parties. Upon expiration of the quarantine period, all personal data is deleted or anonymized. Some personal data may be retained for accounting purposes as required by law.

Location data: Our access to your location data can be restricted by disabling PTX location data access by saying no when you are asked to share your location. Please note that such restrictions will create limitations on how you can use PTX. It may further result in PTX not functioning properly. This is solely a consequence of the disabling the location data and we are not responsible for these consequences.

Other data protection rights: You may have other rights in personal data concerning you depending on your circumstances. Please contact us if you have further questions regarding your rights.

6. Security

We employ routines and measures ensuring that no unauthorized persons gain access to any of your personal data. These measures include both physical and logical measures, risk assessments, and routines for handling data and following up requests about access to and deletion of personal data.
